Khabo Terms & Conditions
Effective Date: 19th September, 2025
Welcome to Khabo, a multi-vendor food delivery service operated by Sofodel (“we”, “us”, “our”). By accessing or using our website or mobile application located at https://khabo.sofodel.xyz/ (the “App”), and/or by placing an order through the App, you agree to these Terms & Conditions (“Terms”). If you do not agree to all of them, you must not use the Service.
1. Definitions

User / You means any person who uses the App, whether as a Customer, Vendor, or Delivery Partner.

Customer means a User who places an order for food or other goods through the App.

Vendor means a restaurant or seller that lists food or goods via the App for sale.

Delivery Partner means individuals or service providers who deliver orders from Vendors to Customers.

Order means a request by a Customer via the App for food/goods from a Vendor.
-
Service means the services provided via the App, including order placement, food preparation by Vendors, delivery by Delivery Partners, payment processing, customer support etc.
2. Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use the Service.

You represent and warrant that you have legal capacity to enter into these Terms.

You will comply with all local laws and regulations applicable to your use of the Service.
3. Account Registration

To use certain features of the Service, you must register for an account and provide accurate, current, and complete information.

You are responsible for safeguarding your password and for all activity under your account.

You agree to notify us immediately of any unauthorized use of your account.
4. Orders, Acceptance & Payment
-
Placing an order does not guarantee acceptance. Vendors may reject or cancel orders due to unavailability, incorrect information, or other reasonable causes.

Prices displayed in the App are set by Vendors; we are not responsible for pricing errors, though we will endeavour to correct obvious mistakes.

All payments are processed securely via our designated payment gateways. Payment methods accepted will be as displayed in the App.

You agree to pay all charges incurred by you (including applicable taxes, fees, delivery charges) in connection with orders you place.
5. Delivery

Delivery Partners will deliver orders to the address provided by the Customer. We strive for timely delivery, but delays may occur.

Delivery times are estimates only. We are not liable for delays outside our control (traffic, weather, etc.).

The Customer should inspect the goods immediately upon delivery. If there is an obvious defect, damage, or shortage, the Customer should inform us (via khabo@sofodel.xyz or within the App) within a reasonable time.
6. Vendor Obligations

Vendors must ensure the food/goods they list are of appropriate quality, safe for consumption (if applicable), and comply with local laws, health, and hygiene regulations.

Vendors must maintain accurate menus, prices, product descriptions, allergen information if required, and stock availability.

Vendors are responsible for preparing the Order correctly once accepted.
7. Delivery Partner Obligations
-
Delivery Partners must maintain appropriate standards of hygiene, safety, and professionalism.

Delivery Partners are expected to follow all applicable traffic, safety, and local regulations.

They should handle food/goods carefully and ensure proper packaging to preserve quality during transport.
8. Cancellation & Refunds
-
Customers may be able to cancel an Order prior to certain stages (e.g. before Vendor accepts or begins preparation). Whether cancellation is allowed, and any cancellation charges, will be as displayed in the App.

If an Order is cancelled by the Vendor or due to error, the Customer will receive a refund under the policies in effect (refund method and timing as per the payment gateway’s policy).

Refunds will not necessarily include delivery fees or other service fees unless otherwise required by law or by our policy.
9. Intellectual Property

All content in the App (text, logos, designs, graphics, images, software, etc.) is our property or the property of licensors, and is protected by copyright, trademarks, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, create derivative works, publicly display or perform any content from the App without our prior written consent.
10. Privacy

Use of the App is also governed by our Privacy Policy, which is incorporated into these Terms. Our Privacy Policy describes how we collect, use, and protect your personal information.

By using the App, you agree to the collection and use of information in accordance with the Privacy Policy.
11. Disclaimers & Limitation of Liability

We provide the Service “as is” and “as available”. We do not warrant that the service will be uninterrupted, error-free, or completely secure.

We are not responsible for any indirect, incidental, special, punitive, or consequential damages arising out of or in connection with the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the amount paid by you in the three (3) months preceding the claim (or such other cap as required by applicable law).
12. Indemnification
You agree to defend, indemnify and hold harmless Khabo, Sofodel, its officers, employees, agents and affiliates from and against any claims, liabilities, losses, damages, costs, and expenses (including legal fees) arising out of or related to:

your violation of these Terms;

your use of the Service;
-
your negligent or wrongful act or omission;

any content you post, upload or transmit via the Service.
13. Modifications to Terms

We may modify these Terms at any time. When we do, we will post the updated Terms on the App/website, and update the “Effective Date” above.

Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
14. Termination

We may suspend or terminate your account, or access to the Service, at our discretion, with or without cause, including for breaches of these Terms.

Upon termination, your rights to use the Service immediately cease. Sections which by their nature should survive will survive (e.g. payment obligations, indemnification, intellectual property, liability).
15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India (or the applicable State).

Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of [insert city/state, e.g. New Delhi].
